Due to Western Australia's current housing crisis recent law changes mean that it is now easier to build a Granny flat at your property. Key changes

No planning approval: If a granny flat meets the "deemed to comply" requirements of the Residential Design Codes (R-Codes), it does not need planning approval.

Building permit required: A building permit is still mandatory to ensure safety standards are met, which includes submitting architectural drawings, structural data, and other plans.

Removed minimum lot size: Granny flats can now be built on residential lots of any size, as the previous minimum lot size of 350sqm has been removed.

Maximum size: The granny flat must not exceed 70m² in floor area.

No additional parking: A separate parking bay is no longer required for the granny flat in most situations.

Design flexibility: Granny flats are no longer required to be compatible with the design of the existing dwelling.

Permitted on more lot types: Ancillary dwellings are now permitted on grouped dwelling and strata lots.

How to Proceed

Engage a builder: Hillside Building Solutions can design and submit an application for a building permit for you. We will handle the detailed plans and the application process, which can be certified or uncertified depending on your choice of building surveyor.

Get a building permit: The building permit application will be reviewed by the council or a private building surveyor and typically takes 10 to 25 working days to approve.

Start construction: Once you receive approval, construction can begin.

Final inspection: After construction, a Certificate of Construction Compliance is issued after the final inspection, allowing you to use the granny flat legally.
